NYC LL97 Compliance

2025 is the first year in which owners of buildings in NYC are required to file annual Local Law 97 compliance reports. Reports are due May 1st, and must be completed by a registered design professional, such as RDA.

Penalties for failure to file are $0.50 per gross square foot per month of delay after May 1st until a report is ultimately filed. There is a 60-day grace period beyond the deadline for reports to be filed without penalty, and the owners who have contracted an RDP before February 1st may be eligible to apply for a further 60-day deadline extension.

Filings need to include:

i) An energy benchmarking report attested to by a licensed engineer, and
ii) A gross floor area report attested to by a registered architect.

The City is also requesting that Local Law 88 (lighting and submetering) compliance statements (attested to by a registered design professional, licensed master or special electrician) be included with the 2025 filing.
